(Jakarta Globe) Jakarta Court Cancels Ministerial Decree on Romahurmuziy Camp

Jakarta State Administrative Court has struck down a ministerial decree issued by the Ministry of Law and Human Rights that recognized M. Romahurmuziy as leader of the United Development Party (PPP).

The court granted a lawsuit filed by supporters of Djan Faridz, who leads an opposing camp in the party, against Justice and Human Rights Minister Yasonna Laoly, who last year issued a decree declaring Romahurmuziy the PPP’s legitimate leader based on a party congress in Surabaya.

The same court “suspended” the decree in November last year and ordered Romahurmuziy’s side to delay acting on the ministerial order.

On Wednesday afternoon, however, presiding Judge Teguh Satya Bhakti ruled the decree was illegal.

The decision will likely reopen a messy rift within the party that started after former chairman and graft suspect Suryadharma Ali was ousted.

Djan, a former minister of public housing, challenged the ministerial decree on the grounds it did not go through the correct process.

He said the Law on Political Parties stated internal disputes should be handled by an internal council before the government intervened.

“Even the party court has declared that Djan Faridz’s leadership is the legitimate one,” said lawyer Humphrey Djemat.

Romahurmuziy said his camp would appeal the ruling.

“To respond to the ruling, the PPP’s board of leaders from Surabaya Congress and leaders of the PPP faction in the House of Representatives will appeal to the higher State Administrative Court,” he said on Wednesday.

Romahurmuziy said until the appeal was ruled on, or the minister withdrew the edict, his camp would legitimately represent the PPP in local elections and other activities.

“We predict it’s going to take one to two years,” he said.

Romahurmuziy’s supporters have started compiling material needed for the appeal. The PPP chairman said they would use material that wasn’t considered during the hearing and also make a point of mentioning the “strange things” that he saw at trial.

“The judge cried when he was reading the ruling. It was really unusual and showed how they were under pressure from a mob of hundreds that was intentionally brought to the court to intimidate the judges,” he said.

Suryadharma — a key supporter of Djan — was also at the trial, accompanied by fellow PPP politicians and supporters.

“The judge has decided and used his conscience,” the corruption suspect said.
